Terms of Service

1. Acceptance of Terms

By accessing or using SAPPLANTA (“the Platform”), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Platform. These terms apply to all users, including free and paid plan subscribers.

2. Description of Service

SAPPLANTA is a multi-model AI platform that provides:

• AI-powered chat with intelligent model routing
• Code generation, execution, and debugging
• Image and video generation
• An AI Marketplace for buying and selling AI-generated content and digital files
• Developer API access
• Credit top-up and subscription management

3. Account Registration

You must create an account to access most features. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate information and keep it updated.

4. Acceptable Use

You agree NOT to use the Platform to:

• Generate illegal content, including CSAM or content that facilitates violence
• Engage in fraud, phishing, or other deceptive activities
• Spam, abuse, or harass other users
• Attempt to reverse-engineer or circumvent the Platform's security
• Use the API to build competing AI platforms without written permission
• Upload malware or harmful code
• Violate any applicable laws or regulations

6. Payment & Subscriptions

• Subscriptions are billed monthly and renew automatically
• You may cancel at any time — your plan remains active until the end of the billing period
• Credits reset monthly and do not roll over
• All payments are processed by third-party providers (Safaricom, NowPayments, Pesapal)
• We do not issue refunds for used credits or consumed services
• Failed payments may result in plan downgrade to Free

7. Intellectual Property

AI-generated content created using the Platform is owned by you. The SAPPLANTA platform, branding, and code remain our intellectual property.

8. Disclaimer of Warranties

The Platform is provided “as is” without warranties of any kind. AI-generated content may be inaccurate or incomplete. We are not responsible for decisions made based on AI output. Always verify critical information independently.

9. Limitation of Liability

To the maximum extent permitted by Kenyan law, SAPPLANTA shall not be liable for any indirect, incidental, special, or consequential damages. Our total liability shall not exceed the amount you paid us in the 30 days prior to the claim.

9a. Trading System

If you connect your own Deriv account to the SAPPLANTA Trading System, the following additional terms apply, alongside the full Trading Risk Disclosure:

• You connect via an API token, never your Deriv password, and the connection carries no withdrawal capability
• Only live (real-money) Deriv accounts are accepted — demo accounts are rejected automatically
• You retain full ownership and control of your Deriv account and funds at all times
• You may disconnect at any time from your dashboard or by revoking the token in Deriv
• The Trading System is free to use — no subscription fee or profit-sharing applies
• We do not guarantee profits, a specific win rate, or risk-free trading; individual trades can lose
• You are solely responsible for understanding the risks of automated trading before connecting a live account

10. Termination

We reserve the right to suspend or terminate accounts that violate these Terms, with or without notice. Upon termination, your right to use the Platform ceases immediately. Marketplace earnings pending payout at termination due to ToS violations are forfeited.

11. Governing Law

These Terms are governed by the laws of Kenya. Any disputes shall be resolved through arbitration in Nairobi, Kenya.
